IndiGo Takes Flight Against Mahindra Electric Over “6E” Trademark

India’s largest airline, IndiGo’s parent company, InterGlobe Aviation, is locked in a legal battle with Mahindra Electric Automobile Limited (a subsidiary of Mahindra & Mahindra) over the use of “6E.” The dispute arose after Mahindra launched its first electric vehicles, the XEV 9e and BE 6e, last week.

IndiGo uses “6E” as its callsign and has built its brand identity around it. This callsign extends to passenger services like 6E Prime, 6E Flex, and 6E Add-ons. They also hold the registered trademark “6E Link.”

IndiGo argues that Mahindra’s use of “BE 6E” infringes on their trademark and could lead to consumer confusion. “The ‘6E’ mark is an integral part of IndiGo’s identity for the past 18 years,” the airline stated. “Any unauthorized use… constitutes an infringement of IndiGo’s rights, reputation, and goodwill.”

Mahindra Electric, however, believes there’s no conflict as their trademark includes “BE” before “6E.” They claim this distinction eliminates confusion, emphasizing the different industries (airlines vs. electric vehicles) involved. Mahindra reportedly seeks an amicable solution through discussions with InterGlobe Aviation.

The case, titled InterGlobe Aviation vs Mahindra Electric Automobile Limited, was presented in court on Tuesday. With no judgment yet, the next hearing is scheduled for December 9th. Mahindra Electric secured trademark approval for “BE 6E” under Class 12 (motor vehicles), further fueling the legal battle.
